Oh yeah...I've read that report. Dude just walk out if u dont like the process. Nobody is stopping u. Do u think things are faster in the country u came from? But when u come to another country u want things to happen like that. Yes 7 years is slow. But if millions keep coming into this country what can the USCIS do? Its clearly an overflow which they cant handle. Before u give a red think twice. Read clearly what one is trying to say. I agree with IV's fight for speedening of the process. But to blame the USCIS and to ask for a change in management is too much. We have NO RIGHTS WHATSOEVER to ask for that.
Somebody said that you don't deserve a second but I dont mind spending few just to make few things straight here.
1. We (the EB applicants) did not cross the border overnight. We were interviewed, shortlisted, H1B applicaion processed, approved and at the port of entry, we were welcomed by the officials. We did not sneak through.
2. Just because corruption prevails in India, it does not mean people can be treated badly here. Corruption in India is none of US business. We are here on business. US want our skills and we need the dollars. Period.
3. Beyond that, employers here (it could India or China based - but are established organizations here) see a requirement for our skills in future and US government is verifying that through LC and I140 and offering us GC. Now the fact that US immigration is broken is evident enough that this country is not error free. Every country has its own problems.
4. Let's talk about corruption. Where on earth is there no corruption? Whereever human beings are, there is corruption. 100%. It's here in the USA, its there in Japan, its there in Gulf. Everywhere. I am not saying corruption is good but is inevitable.
If you say, US thinks that because these guys are from India where corruption is to the core, and these guys have half the facilities (back home) that this country provide and hence deserve a broken immigration system that screws up their life, then my friend, this country is no better than any other country on this earth for being so mean. And, for that reason, if you ask me to get out of this country, I would like to say, humbly, that is none of your problem. If yes, ask every US organization that is trying to exploit the business potential in India to get out from India. When the last US business leaves India, I will leave this country.

I totally agree with you on this. But I am not talking about the MTR. I am talking about the fee issues. Why do we need to pay if its their mistake. I dont think we are talking about the fee waiver with congress men's office or anyone else.
I agree. We definitely need to get some kind of process to correct "service errors" against filing MTR which is associated with a cost.
Remember MTR is basically for presenting NEW FACTS and not to correct service errors.
If members can come up with innovative ideas of correcting these issues, we can definitely do campaigns.
All we need is cooperation and help from members.
AC21 denials is clearly a service error and when one invokes AC21 the person should not be punished by slapping a denial and making him/her accrue unlawful status and forcing them to open a Motion.

Ooh - you are right !!! It took me more time to write the above than it took 25 USCIS workers to approve 25,000 I-485's... (48 hrs X 60 mins X 25) / 25000 = 3 mins.
They are thinking us dumb fools because we are immigrants and we have to accept whatever they say !!
I doubt if anyone was denied. They have to approve anyone and everyone to meet the numbers.

Nope and I just filed for my first exension.
but my Licences expires on Sept 2008, So I will I be just getting the extension till Sept 2008 and Not 3 year extension.
That just sounds ridiculous... what does your driver's license have to do with your H1B extension?
It's true that the length of your H1 extension determines the validity of your DL i.e. if you get an extension until 2010 the DMV will only issue a DL valid till 2010, but the opposite is not true, unless we're living in the Twilight Zone.

I do not buy this argument because how come NSC is approving peoples I-140 filed concurrently in July-Aug 2007 or even non-concurrently filed as late as Oct 2007? How come Eb2 is moving so fast in NSC ?

The poster got the same reply after contacting USCIS through senator/congressman.

On other side members feel uncomfortable as nothing comes out as solid / strong plan of action. There were couple of instances were I personally felt that core talks too much among themselves and release almost zero information to members, it may be good for community overall but not good for an organization where everyone is participating directly or indirectly. By recent posts by Pappu, I think they are improving.
We need to give them a chance as anyways their act is selfless. They may be lagging in personal management but they are not bad by heart or doing anything for personal benefit.

one of my close friend grew from a regular programmer to the position of VP in the span of last 6 years. he is facing lot of issues with GC.
clearly mirage didn't mean growing to the position of exactly VP. he meant a higher and slightly different position, for example an IT Manager. It is not that uncommon, for a IT Progmr who works in the same company for 5-6 years, offered a Manager position.

I have been intending to post this for a while: I still have major doubts on the predictions made by DOS. We all are grateful to them to at least do an effort to provide such predictions, but things don't add up.
It is everyone's understanding that these predictions are based on the information about "preadjudicated applications" from USCIS. Now if you look at the total number of preadjudicated applications from what USCIS has published, it seems that PD (for EB2 India) will move to at least to 2007 if not 2008 by the end of fiscal year 2010. There are no new 485 filings (except for EB1 and EB2 ROW) and unless there is a "HUGE" increase in these categories, there is no other way to explain the basis for these predictions.
Someone else mentioned in this thread about the large number of filings in 2005 due to PERM, but remember, this should already be accounted for in USCIS's preadjudicated numbers.
So either these DOS predictions are some form of scare technique, or too much conservative estimate (so as not to disappoint people) or there is a missing piece of information that we have no clue about.
In any case, I do not claim to be a "better predictor" than DOS; but reality is that all these are pedictions and we have to wait till July-Sept 2010 to find out the truth.
Hoping for the best....:)

With the bad economy, there were less number of PERM applications filed in FY2009 that will claim visa numbers in FY2010. Also, with DOL taking ages to approve new PERM applications, there will be less applicants, that filed PERM this FY, claiming visa number. Thus, there will be lot more spillover this time than previous years. IV has taken this into consideration while doing its math but we cannot expect the same from USCIS. I think EB2I should at least move till mid if not till 2008.

I do not believe the 800,000 figure for I-485 alone. It could be a misquote from Aytes. The 800,000 is possibly combination of all immigration related applications such as I-140, 485, 131, 765, etc.
Even during last year when EBs are current, it didn't reach that many applications. I believe Matthew OH is more accurate in saying there's a total of 320,000 I-485 applications.
With that figure, average 2.5 years waiting is in order. But that should not be distributed equally among all countries due to per country limit. I would guess, for India and China, it would be 3 years wait, and for the rest, 2 years.

I've sent 7001 to Ombudsman , Contacted Congressional offices and ultimately filed a Service request in Nov 1st week. After all this NSC opened my case yesterday Dec 9th and the status changed to "RFE sent" - there you go ! They bought at least 2 months extra time.
What a bunch of jokers at NSC - my case was extremely straight forward :(

They both listened to what I had to say and assured that they will pass the message on to the Senators.
One of the aides sounded surprised when I told her average wait time is at least 10+ years, please call senators in the list.

Thats a mess forced onto themselves. However, iam feeling happy and lucky about it. The hardships of USCIS employees started off from mid june and will never end just because of mess & mass miss-communication between the agencies.
Since I was bored at work, I called this number and talked with a rep this morning @10. She told me that they have 76K applications pending for the receipt date as of July 27th. She said this two times thinking me to take on with surprise with this huge number. Yes, of course I am surprised. Is it only 76K apps by July 27th?
