The new visa bulletin is out at this link: http://www.travel.state.gov/visa/bulletin/bulletin_5145.html. Employment-based categories are as follows: EB-1 remains current for all countries; EB-2 remains current, except for India and China which are at May 2006; EB-3 is at Jan. 2005 for all countries, except for India (Jan. 2002), China (Nov. 2003), and Mexico (April 2001); EB-3 other workers is at March 2003 for all countries, except India (Jan. 2002)and Mexico (April 2001); EB-4, religious workers, EB-5, and targeted employment areas and regional centers are all current. Family based petitions are backlogged, with the most recent date at April 2010.

The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. The details described by Bernstein will no doubt enrage you. The obvious monumental effort Ms. Bernstein put in to bringing this story will also likely move her on to the short list for a Pulitzer Prize for this hard-hitting piece of journalism.

At a time of historically high unemployment rates, when it becomes convenient, even �fashionable� to highlight the frailties and abuses of the H-1B program, it is refreshing to take note of the �feel good� story of certain immigrants who have come to this country and achieved greatness and are living the �American Dream.� Indeed, the recent Nobel Prizes awarded this week to the first six (6) Nobel Laureates were to U.S. citizens�four of whom were born outside the United States. Perhaps we should take a closer look at the current popular theme of closing our borders to protect U.S. workers....

Hi All,
My hubbys PD is dec 04 Eb2. His I140 was filed on July 07 and in aug 07
we have applied for I-485.
I got the I-131 receipt notice which is having A# number.
Does A# number means 140 approval ? Online status of 140 shows as pending?

Guys,
As most of you know we formed a focus group to work on the 'Country Cap issue'.
We have a letter ready to be sent out the the lawmakers to lift the Cap - may be temporarily- I would request you guys to spend 5 minutes and 42 cents and send it out to your senators and congressmen/Congresswomen�.If 50 people from California can send this letter to 'Congresswoman Zoe Logfren', I'm sure it will some some difference...

Hi,
Me and my wife went to India and I came back one week back with my ex employer visa without any problem,I had to show only the I-797 for the current company where I am working. My wife she is still in India coming back to US in September.
I am sending my I-797 original to her in the mail.
My concern is will the immigration officer ask her for my I-797 approval or her I-797 approval ( she is on H4). We don't have an I-797 approval for her as my H1 was applied before we got married.My current H1 is expiring on Jan 19th 2009 so we applied for extension for both of us and got the approvals but its only valid from Jan 19th 2009.
Any replies greatly appreciated.

I know this issue is still a grey area and certainly no one seems to know a concrete answer to this.
If i have my H-1 Visa and EAD as well. Can i continue to Work on my H1-visa for the primary employer and take up a part-time job with the EAD.
I have hear ppl say that H1 becomes void once EAD is used. Is there any kind of document advocating this? I have not seen any. Lawyers have conflicting opinoin. Has anyone thought about this. I have decided to take an infopass appointment and ask the IO to show me a document that states that H1-becomes void or The other way around.
Can anyone shed more light in to this. Thanks

I just contributed my second contribution of $200.00(so far $400.00)
I was just thinking about it, it is still less than what I am earning in one day.
And I am sure it is less than what your consulting company makes(or takes) from you in two days(some times one day)
Think about what these guys at IV are doing for us(and ofcouse for themselves)
Please do your part by contributing. When sombody is willing to donate their time/effort for free, we should make use of it properly(no point in regretting later).
It is dissappointing to see that most of us lack motivation.
Please do your part today. Let us make it a movement.

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

How can we help ourselves to get 2 year AP ? IV admins, can you kindly share with us any info regarding this ?
I know at this moment everyone is looking at the stimulus plan and economy, but , in the mean time we can prepare ourselves with some plan of action...
May be we should push for 3 year EAD/AP . Our argument should be, if we are 3 or more years away ( like EB3 India is currently 2001 or something ), we should get 3 year EAD/AP
Not meant to talk only for EB3 community, but in general as well.
Any thoughts IVians ?

The analysis of census data from both the U.S. and Mexican governments, being released Wednesday by the Pew Hispanic Center, highlights the impact of the economic downturn on Mexican immigrants, many of whom enter the United States illegally. The study found that immigrants arriving from Mexico fell by 249,000 from March 2008 to March 2009, down nearly 60 percent from the previous year. As a result, the annual inflow of immigrants is now 175,000, having steadily decreased from a peak of 653,000 in 2005, before the bursting of the housing bubble dried up construction and other low-wage jobs.
The total population of Mexican-born immigrants in the U.S. also edged lower in the past year, from 11.6 million to 11.5 million, according to the study by Pew, an independent research group. Up to 85 percent of immigrants are believed to be in the country illegally.
