The USCIS has issued guidelines for petitioners filing cap-subject H-1B petitions for Fiscal year 2011. I appeared for h1b stamping at new Delhi us embassy. VO kept my passport and forms for admin processing. VO told me it may take 2-4 weeks. they didn't give me any slips ( pink/yellow/green). I am not sure what kind of processing they wanted to do in my case

I will be filing my EAD renewal end of this month at NSC.

Yes, even primary applicant can work on EAD & 1099. But in case RFE is issued for EVL the primary applicant should have permanent full time position.

Hi,
I see a LOT of the same questions being posted over and over again. (eg. H1b Transfer, Eb3 to Eb2 etc). I also see that the Questions answered by the lawyer are quite hard to access and the info about the next call etc is also quite hard to get to.
How about we bring the 2 worlds together. We have a Menu Item on the Left saying either "FAQ's about immigration" or "Q/A from lawyers" etc. and somewhere on the homepage plus in the forums section we put some text saying "Before posting please check out the answers from lawyers" and put a link to the same.
Along with that (if possible), we also put all the questions and how many have been answered and which ones are going to be answered.

I think most Immigration Judges try to do their job in a fair way. But there are a few that really cross the line way too often. The press has covered this and I've tried to bring some of these problems to light in this forum. Now EOIR wants people who have been victimized by poor conduct from an Immigration Judge to complain and they've established a complaint portal on their web site.

Wilmer Rivera Melendez, 61, pretended to be a lawyer and offered to help more than a dozen undocumented Guyanese immigrants in Brooklyn to get green cards, has been indicted in an immigration fraud scheme in which he is accused of offering to marry two illegal Guyanese immigrants in Brooklyn to help them gain legal status. Robert M. Morgenthau, the Manhattan district attorney, also added that this man was earlier convicted of bigamy in Georgia six years ago.
Mr. Morgenthau claimed himself having 20 year of experience as a lawyer, filed documents with immigration authorities for �withholding of removal� that would have allowed immigrants to remain in the country and obtain green cards, which is actually does not allow one to obtain a green card. Instead, Mr. Melendez�s actions led federal immigration officials to begin deportation proceedings against the 14 Guyanese immigrants. The law provides for illegal immigrants who are victims of violent crime to receive temporary visas, but not victims of fraud.

I am on L1 and my wife was working on L2 + EAD since Aug-2007 with her employer.
She got her H1B approved in Oct-2009 with the same employer - which means that she automatically moved to H1B, correct?
We went to India but she gave her L2 I-94 on departure and did not give H1B I-94
She entered back to US on L2 on 03-Jan so I am assuming that her status has been updated to L2 now.
Please advise if at all she needs to move to H1B again since her L2 EAD is still valid.
If she needs to move to H1B, then what is the best way, we can easily go to Meixco for stamping from LA.

Folks,
I know this may be a little of topic but just bear with me. I am simply looking at alternatives in case the GC does not pull through. Does any one over here have any experiences living and working in the Middle east ? I just read an article about Saudi Arabia's economy dealing with record unemployment. They are in the process of taking jobs away from foreigners and giving it to the locals.
Where do we go to look for jobs in the Middle east. Any advice on this topic would be greatly appreciated. I'm praying my GC does finally pull through.

I had been in H-1B status and was laid off. My H-1B was withdrawn by my company on 12/31/2010. I applied for COS to B2 and received the USCIS receipt notice on Dec 17th, a few days before my H-1B was withdrawn.
Later on Feb 2nd, 2011, I received the approval notice from USCIS for B2 valid from 02/02/2011 to 04/29/2011(I had informed in my application that this would be my date of departure.) My question is: What status would I be from the date my H-1B was withdrawn till the B2 validity start date?
Forum members, please clarify.

In theory, you don't have to be in the US for any part of the permanent residence (PR)process. A company could do a labor cert and I-140 for you, and then you could complete the PR by interview at a consulate, and only then start working for the US employer. In practice, of course, that never happens. However, it is possible so that you can safely go to India.

You need to have an 1-485 application in at least for six months before using portability.
You can contact a body shopper and ask them to file I-140 and use your current priority date.
There is nothing else possible if you are already at your sixth year of H1B.

Given the Times Square bomber Faisal Shahzad�s immigration history, the common refrain of �let�s just close our borders to all immigrants� is (not surprisingly) becoming more vocal. After all, as the argument goes, if someone like Shahzad (who apparently is not one of the �best and brightest�) is able to obtain a student visa, then an H-1B �specialty occupation� work visa, a green card, and the ultimate prize of U.S. citizenship � all in a span of less than 8 years -- then perhaps we need to take a step back, take a deep breath and just close our borders...
