My friend needs to attend a family urgency and planning to travel immediately . His AP is expiring on 3 Sep 09( 4 days ) . He is working on EAD and is in Adjustment status he is yet to start the AP renewal process ...any advice appreciated...

All,
I'm a EB2 filer and PD is 2003. We did a concurrent filing on Jul 2nd, received receipt notices for the same, FP Completed and EAD approved.
I see the A NUMBER printed on my 140 and 485 receipt notices. I wanted to understand whether the 'A' number mentioned on the receipt notices is the VISA number or, the VISA number is something different that gets assigned during the adjudication of I485 based on the availability.
Trying to assess the impact of EB2 retrogression on cases that are already filed and Finger printing is complete.
Please Advise.

I am on 7th year of H1B with approved 140. 485 not filed yet.
My company is starting layoff and I am afraid I will be hit. If I switch to H4 after being laid off and found a new employer in future, is that possible to switch back to H1B without having to leave the country for a full year?
My current H1B was a three year extension based on approved 140, but I don't know if I will lose the benefit of AC21 and cannot change back to H1B once I switch to H4 since my 6 years have been used up already.

I have changed to a new employer and have mailed AC21 documentation to the nebraska service center at the following address using FEDEX.

It is 2 weeks now that the mail has been delivered. So far I have not seen any soft LUD's on either my pending I-485 or approved I-140 cases.
- Would the LUD's be seen at all on these? How many days after sending the docs would you see the LUD typically?
- Is there any way we can call and confirm that the new employer details are applied on my I-485 case?

I got a soft LUD on my 485 on 06/03/08 and same on my wife's 485. I am the principle applicant. I called Customer service center and they said the only update they see is that I have updated my address on file in January or 2008. I asked her what could be the reason for LUD on my case to that she replied that since the NSC processing date is past my filing date she can create a Service Request for me. I have done that but I am still concerned what the cause of this LUD is . Does anyone know why there would be a soft LUD.
MY priority date 02/13/03 is current now. Sorry I dont have other details of my case.

1) Shall I disclose the arrest to the attorney ? I am concern that it may backfire as I said "NO" for arrest in the background check forms etc.
You Should say "YES" and produce all the court records.
2) Can I travel & enter US without any issues ? Do I need to carry the expungement letter with me all times entering US?
I would advise not to travel unless you get an attorney to review all your documents and get a confirmation that you are not subjected to any bar under Sec 212 of the INA.
3) Does my arrest go to FBI ? Will I be asked for interview when my PD becomes current ?
You could called in for an interview. But there shouldn't be any problem once you have all the records.

I will be going out of the country for few days in early Sep. I wanted to know can I apply for my renewal of AP now. I read the following in the I-131 filing instructions (page-4)
If you travel before the advanced parole document is issued, your application will be deemed abandoned if:
1. You depart the United States; or
2. The person seeking advance parole attempts to enter the United States before a decision is made on the application
So can I apply for my AP renewal now (I am assuming if I apply now it won't get approved before my travel in Sep) or do I need to first complete my travel in Sep, come back to US and then apply for the renewal.

(1) I have applied my Labor Certification in February 2003 and It is approved in September 20, 2007. After almost 4 years. Now, my employer is ready to file I-140 by October 10, 2007. I am also in my 7th year of H1-B visa and it is expiring in August 24, 2008. I have heard that you need to have 365 days of time period between Labor Approval and H1-B renewal of VISA for 8th year. If my I-140 is still in pending stage until August 2008, still Will I be able to get my H1-B extension for 8th year? In reality, I am short of 60 days to finish the count of 365 days.
(2) On the other side, I may not have worry as my Labor was filed in year 2003.

As Senate Democrats were preparing to go to the mattresses over Iraq voting procedures and as Republicans threatened to stop all activity over a judicial appointment, it's worth recalling what Senate leaders were promising at the outset of the 110th Congress.
On Jan. 4, incoming Senate Majority Leader Harry Reid (D-Nev.) declared on the floor that "last November, the voters sent us a message - Democrats and Republicans. The voters are upset with Congress and the partisan gridlock. The voters want a government that focuses on their needs. The voters want change. Together, we must deliver that change."
Minutes later, Minority Leader Mitch McConnell (R-Ky.) observed that "the challenges ahead will not be met if we do nothing to overcome the partisanship that has come to characterize this body over the past several years. A culture of partisanship over principle represents a grave threat to the Senate's best tradition as a place of constructive cooperation. It undermines the spirit and the purpose of this institution. And we must do something to reverse its course."
Six months on, the Senate has devolved into a nonstop brawl. The House, where leaders made let's-work-together promises of their own, also is a cauldron of partisanship, but at least there the rules permit a majority to rule.
But together, they've been able to pass just three pieces of significant legislation - a hike in the minimum wage, expansion of stem-cell research funding and a supplemental appropriation to fund the Iraq War. Only the first was directly signed into law. The second was vetoed by President Bush. The third was vetoed then passed.
Partisan warfare and inaction on issues from health care to immigration to energy - even lobbying and ethics reform, once the top priority for this Congress - has reduced respect for the legislative branch to its lowest level ever. Respect for the presidency is not much higher.
Who's to blame? Senate Democrats accuse Senate Republicans of "obstructionism" - systematic refusal to grant unanimous consent so that bills can be voted upon. Senate Republicans blame Reid for invoking cloture to stifle full debate and the offering of amendments.
The level of rancor is escalating now because Democrats are frustrated that Republicans are insisting on a 60-vote threshold on Iraq War amendments - as though Democrats in the past have not used the 60-vote requirement when it suited them. Republicans are threatening to create procedural chaos and allow little or no action on the floor if Democrats block a single appellate court nominee.
In January, Senators of both parties gathered in the Old Senate Chamber in what McConnell described as "a small act of bipartisanship" that he hoped would lead to a restoration of the Senate's reputation. Now, perhaps, Senators should regather there and contemplate their current level of public esteem.
