    While there are some politicians genuinely concerned about the subject of immigration who are backing anti-immigration laws because they believe in the cause, there are many more who have jumped on the anti-immigration bandwagon to score political points (John McCain - I'm talking to you). I wonder if politicians in small towns that don't have a lot of fat in their budgets are going to re-evaluate the costs and benefits when they have to explain to constituents why they have to pay hefty fees to plaintiffs in lawsuits like this one in a small town in Nebraska.     Hi Friends,

    I have a 4 yr Bachelors degree (B.Tech) in IT from India and also have MS in Computer & Network Engineering from UK.

    Now my question is since most of the UK universities offer MS for 14-15 months, can I quailify for EB2 Categoy?

    Hi, Last year, I heard about a new rule that says that H4 time will not be counted against H1 time so basically, if someone is transferring from H4 to H1, the time spent in H4 will be excluded while deciding the duration of H1.
    Is this rule true ? I mean, has it become a law now ? Did somebody use this rule to grab the time spent in H4.
    Please let me know.

    There is so much dysfunction in USCIS. See the complaint to investigate this problem. There are folks sitting from 2001/2002 and USCIS does not bother about their petitions.

    Does anyone have the latest on labor substitution? I am being offered a pre-approved labor. I will have to switch to a not so good employer for the same. I want to know if there are known rumors at this moment about cancellation of pre-approved labor.
    Any advice would be highly appreciated.

    It depends upon your luck with AP. Because you never know when they will be approving your AP and in case it is lost in Mail (it happens to lot of people) and you need to re-apply with fees again. This is very tricky....... You may get it in few weeks or few months or never. Not to discourage you, it really how lucky you are. All the best. I always will file 3-4 months in advance.

    I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

    Hi
    I just got off infopass appt. after talking to someone in USCIS serv center.
    was told that the case is in the examination section. He did not give me any details as he said thats all what he sees on the screen.

    any one tell me what that means and how long could it before they will adjudicate?

    Below is my current GC & H1-B status

    1. Have an approved I-140 with my current employer. Waiting to file I-485.
    2. Pending H1-B extension petition based on approved I-140


    I'm looking to move from engineering to marketing with the same employer. I know I have to refile labor and I-140 and claim the PD based on the already approved I-140. Can I move to marketing from engineering? The job responsibilities are totally different and my current H1-B extension petition is for engineering position only. I need to file for a H1-B amendment based on the new marketing position.

    Will i be able to move smoothly within my current company. If not what will be some roadblocks? Any advice or insights is highly appreciated

    my husband's h1 ext is approved.
    my h1 to h4 cos is still pending. If we go to canda for his h1 stamping and my h4 stamping with my h4 filing papers ( i-539) and receipt notice and come back to usa with successfull stampings, how will uscis know that i travelled to a consulate and got h4 stamping done.
    Will they still continue to process my h4.
    Do i have to inform uscis after I come back to usa of my successful stamping.
    what should I expect on my pending case once i come back.

    I am currently on H1B with a temp status (B1) and in-between jobs. My partner is in the process of becoming a US citizen. He has had his Green Card for years and obtained it through his ex-spouse's job while they were still married. He has been divorced for about a year now and started the citizenship application process a couple of months ago. We are thinking of getting married after he gets his citizenship. My question is: does it matter if we get married before or after he obtains his citizenship? We heard rumors that a previous marriage might be a factor in whether I will be able to obtain a Green Card. Thank you very much in advance for your help!

    Shouldnt be an issue as GC can be for a future job.....For H1 stamping, your current job requirements and title should be same as the requirements/title on your H1 petition/LCA....
