    Folks,

    I have a coworker who is a citizen of Canada and got I-140 approved yesterday.

    The question is how safe, easy and hassle-free it will be to do a CP (Counselor Processing) from Canada instead of I-485? CP will be done in US embassy in Montreal. Do you guys know any experiences from your other friends? Any relevant information will be appreciated.

    What not to wear in court. In court one should present oneself as professionally as possible. Usually this means a suit for men, and a conservative dressy outfit for women. No jeans in any case, and business casual may even be too casual, so khakis may even be somewhat under-dressed. But I suppose it depends on the court.

    Do nothing. It is an oversight and not worth worrying about. You can send them a letter and they will put it in the file but it isn't worth much.

    My cousin got a H1B petition approved (via the lottery system) last year. One consultant in the US had filed his H1B, and my cousin was asked to pay for the entire process, which he did. But, nothing happened last year after that, because the job market turned worse. My cousin did not appear for the visa interview.
    Now, when he is trying to get in touch with the consultant, he is not getting any response. What are my cousin's options now?

    Sorry for the cross posting.

    My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.

    My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.

    Did anyone who filed in end June have their 140 premium processing returned?

    Hi Ron,
    We all appriciate your support and help. My citizen mother has filed the immigation petition under F1 category. Currenty I am in US on H1B. Priority dates are near and I am palnning to file AOS. Category F1 is Child of unmarried son of US citizen.

    The LCA and Petition papers used for the my H1 Visa (at consulate interview) has the Job Title Programmer I. But before coming to USA I got reassigned and I got a new LCA from the company (I got new LCA in India itself). Recently I looked into that New LCA it has recorded my Job Title as Programmer II. I am working on this new LCA location.

    I have following question.

    Does this Probrammer I/ Probrammer II change in LCAs affects my AOS for my family based category F1. (AOS H1 -> F1 Family based)

    Considering many limitations to move a job from non-profit to for-profit, I am considering moving my job to another non profit. With my current employer, my 6 year H-1 B will expire by the end of next year April. So if my change my employer, I will have a very short time to start the process again till I reach I -140 approval again with the new employer.

    I heard that from non-profit to for-profit, you are subject to the quota and you have to apply for H-1B quota. But in this case, your previous 6 year with non profit doesn't count.

    But if I move from non-profit to non-profit, do I have to reach I-140 approval before my current H-1 B with my current employer expires? Or do I just get another 3 year with new non-profit employer?

    If I have to get I-140 approval with new non-profit employer before my current 6 year H-1 B expires, is it doable?

    Dear Attorney,

    My I140 got approve from A company when I was working in company B.( I applied for I140 from company A and left the company after 5 months due to some reason). My approved I140 is still valid as I went to USCIS website and check the case status using EAC number.

    This is my 5yr on H1 visa.

    My question is:
    - Can I transfer my H1 to company C using A company I140 EAC number and get 3 yrs of extention? ( I only have EAC number of approved I140. A company have refused to give me copy of approved I140 as I left the company.).

    FORGET ABOUT November's bipartisan promises of civility and cooperation in Congress. At the time they seemed overly optimistic. Nonetheless, it is hard to believe that relations could have deteriorated so far so fast -- both between the new Democratic majority and congressional Republicans and between Democratic lawmakers and President Bush.

    Thursday's late-night rumble on the House floor, when a vote was gaveled to what Democrats acknowledge was a premature close, epitomized the ugliness that has overtaken the entire legislative process. In the end, the 110th Congress headed for its August recess with civility in shreds and achievements sparse. Indeed, the only thing that might make August look pleasant is September, when lawmakers will return to resume the acrimonious debate over Iraq policy and confront the looming end of the fiscal year with spending bills unpassed and presidential vetoes in the offing.

    There have been scraps of good news from the first seven months. Lawmakers managed to see two of their priorities become law: an increase in the minimum wage and passage of the recommendations of the Sept. 11 commission. Another major achievement, a lobbying and ethics reform bill that will make important changes in the way Washington does business, is awaiting Mr. Bush's signature. Both chambers passed versions of a measure to extend the health insurance program for children in low-income families.

    But many other Democratic priorities -- and a big presidential one, immigration reform -- were snarled in the Senate. The 60-vote majority needed to overcome a filibuster proved to be as big an impediment for majority Democrats as the Democrats had made it when Republicans held power. The failure of immigration reform, of which there had been at least a hope of bipartisan achievement, was a particularly low note. Meanwhile, Democrats in both chambers chose to spend countless hours mired in a fruitless effort to compel an "end" to the war in Iraq.

    One of the most disappointing recent developments has been the administration's apparent decision, in the aftermath of the immigration bill's failure, that there was not much to be gained from working with this Congress -- and something to gained by taking it on. This new belligerence has manifested itself in a blizzard of veto threats -- Democrats counted up 31 between May 1 and Aug. 1 -- the most regrettable of which involves the children's health insurance bill.

    In the final hours before recess, it was hard to know which was more shameful: the administration's use of the looming vacation to bully Democrats into accepting its overbroad rewrite of the Foreign Intelligence Surveillance Act or Democrats' spinelessness in caving to this strong-arming.

    On the House side, a major disappointment was the failure of Democrats to live up to their pledge to treat the new Republican minority better than Democrats were treated when Republicans held power. Democrats promised a new, more open House, with adequate time for members to digest complex legislation and ample opportunity for the minority to offer amendments on the floor; instead, they, too, often used the same hardball tactics to muscle through legislation that Republicans had employed. That might have been understandable in the Democrats' "first 100 hours" that the new Congress was in session, but it is unfortunate that it persisted until the recess. That's no way to do business, and Democrats know it.

    Will there be any updates on 485 LUDs when USCIS works on I-140?

    I have submitted approved EB3 I140 and 485 on Aug 2nd 2007. I submitted EB2 I140 for approval on Dec 11 2007. There haven't been many LUDs on any of these files except when applied for AP and EAD. Now on Apr 7th 2009 I see new LUDs on EB2 I140 and 485(for both wife and me). There is nothing after that. I am not able to make out anything of it. Any comments, suggestions or opinions are appreciated. Thx

    If you can get to the soft copy of the checks usually provided by most of the banks, you can find the receipt number on the rear/back side of the check.
