The CBO report DREAM Act advocates have been touting reflects a net plus of $2.3 billion against the federal deficit. But that's the SENATE version that was analyzed. If the antis are right and 2,000,000 people will benefit from DREAM, the House version's new $2525 in filing fees will mean an additional $5 billion will be raised. Why, it would be fiscally irresponsible NOT to vote for DREAM!

are you aware of the PACE bill? I am concerned that current PhD graduates and life science PhD graduates appear to be excluded from the adjustment of status benefits proposed in the bill for doctoral candidates. I have drafted a letter and would definitely like IV to publicize it.

1. I got laid off from company A last year. I was on H1B. Company A notified me about 1 month in advance so I had some time to find another job. I also had a valid EAD which I wasn't using at that time. They also did not cancel I-140.
2. I joined Company B using my EAD within the 30 day period, so I never went out of status. Also, I didn't file AC21
3. My GC application was approved in the first week of Aug.
I have a couple of really interesting opportunities that I would like to pursue. My job profile has been similar at both A and B and will likely be similar even in C should I join there. Am I required to work at B for any specific period of time before I can pursue these opportunities?

I got my I-140 Approved (EB3 - Jan 2004) with Company A. Can i use the approval notice and get my H1B extended for 3 years from a different company ? Please advice as this will help me a lot.

An employer did H1 processing for Ms.A on US Masters degree quota in 2007, but she decided to go back to school before the H1 kicked in (communicated the same with H1 sponsor/Employer) and is getting the degree (PhD Engg) in Aug 2010. Ms. A never worked on H1 and continued to be a full time student(made the mistake of telling the university about H1).
FYI: Ms. A traveled to home country and got back on F1 visa in Aug 2007
What solutions does she have now?
1. Get a job, continue on H1 and extend it?
2. Get back to F1 ( graduate in December instead of Aug. Really difficult to find other schools giving I 20 now!)
(Ms.A may have to visit home country this year for personal reasons and visa stamping is required to get back to US!!!)
Is there any other solution?
Do you think consulting two different lawyers is helpful in this situation?
How much may be the Attorney fee ?
Deeply appreciate your input.

According to CNN, America could be facing a nursing shortage that will worsen exponentially as the population grows older. The problem: Baby boomers are getting older and will require more care than ever, taxing an already strained nursing system.
Barry Pactor, international director of global health care for consulting company HCL International, agrees that more nurses should be trained within the U.S. system. But as a short term solution for this "huge shortage," he said the U.S. government should loosen immigration restrictions on foreign health care workers. "I don't see this as foreign nurses taking American jobs, because these are vacancies that already exist and cannot be [filled] by nurses currently in training," he said. "We'd be filling in the gaps until the training can catch up with the demand."

Having a pending EB1 I-140 does not in itself confer any status. If you filed an I-485 concurrently, then you are permitted to remain in the US pending adjudication. If you have a currently valid H-1B you may remain or renew pending adjudication.

I was reading some info abt EAD on this site and have come to know that Once H4 visa holders get their EAD's can work after getting SSN.But I read that If H4 visa holders start working as soon as they got EAD's.Does this invalidate H1 visa status if wife starts working on EAD.Please clarify my doubt.

USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. As such, the Service continues to accept advanced degree petitions as experience dictates that not all such petitions are approvable. Well seems like today both sides are going to blame each other for not having a bill today. Big question is - does discussions/negotiations re-start after the recess or is this issue pretty much dead. Most probably they will announce that they will re-start the discussion after vacation and provide the "most important legislation"...blabla... But what are the chances really? especially with new scandals beginning to take all the headlines. This is really frustrating and unfortunate. Lets see how the day goes.

Hi,
I'm presently in J-2 visa and my husband is having J-1 visa.
We both are Indian Nationals. My husband applied for J-1 visa when he was in Germany.
It is mentioned in my husband's Visa clearly that "Two Year rule does NOT apply".
3 months later, I applied for J-2 from India with his visa documents.
In my visa also, it is mentioned that "Bearer is NOT subject to section 212(E). Two Year rule does NOT apply".
Now, we both want to apply for H-1B visa seperately. I want to know whether do we need to apply for H-1B waiver?
It is very much confusing since we are Indian nationals, the two year rule applies. But at the same time, as he was in in Germany while applying, it does not apply as mentioned in the visa.
Please clarify. Thanks in advance.

My situation is not very urgent, but I like to stay on top of things. Thanks in advance for your help, it is much appreciated.
My F1 visa expires on July 6 of 2011. However, I have an I-20 that permits me to stay in the United States until August 31st of 2012. The reason for this is that I came here as a master's student, but transferred to a PhD program. This is my second I-20.
I have plans to leave for India in May of 2011 and stay until end June 2011. Will it be necessary for me to apply for an F1 Visa extension? Technically I'll be back by July 6, but will it be problematic to get back without a renewed visa because there are only a few days remaining on the old visa? Again, as per the I20 I can stay legally here until August 2012. Is it difficult to renew the F1 visa? All this is almost a year from now but I'm getting quite stressed about the situation. I cannot certainly finish my degree by July 2011.

Candidates already in the US may, if they are on a non-immigrant visa (such as a B1/B2 visit visa), be able to apply to the BCIS for adjustment (if changing to immigrant) or change (if changing to other non-immigrant) of status while remaining in the US. This option is not open to candidates who are present in the US under the visa-waiver scheme. Also, if the candidate did not advise of the possibility of a change of status to the relevant US Embassy or Consulate beforehand, USCIS may be reluctant to permit an application for adjustment of status.
