I am not sure whether my employer will provide the check copies for 140 filing but yeah I have the Fedex Tracking number which shows 140 delievered on 16th July.
Can we take InfoPass Appointment and find out the receipt number from Immigration Officer.
If anyone knows or done this please share.

I have I-140 with substitution pending since March of this year. Can I file for 485 now or do I need to wait for I-140 approval? Thanks.

Thanks Bestin, for the quick update provided on the forums. Was caught up in personal work and hence couldn't update here.
1) Thanks to CC, we had a good meeting. Around 15 members turned up, which is a good show as this is our very first meet as a State chapter. It was a great success as an ice breaker and people could actually see the faces behind the ids walking_dude, cagedcactus, curious_techie, alien etc.
2) Sorry to have not posted pics and videos. It was the first meeting for all of us, though some of have been co-ordinating efforts online through phones and E-mail. Also some of us are prospective AC21 candidates (so you guys need to wait some more months :) )
3) Every one of the attendees pitched in with their ideas and experiences in GC process. We had a fruitful discussion about IV Talking points. EVERYONE readily volunteered to our highest priority task. We will be going ahead with it in full steam in the days to come. Modalities were discussed to and agreed to at the meet.
4) We got some more volunteers who agreed to share the Co-ordinator responsibilities with me and CC. We have formed a "Co-Ordination Committee" of 5 members - CagedCactus, Walking_Dude, Bestin, BReddy2000 and Ajobha. Committe will be dynamic and based on member choice and level of participation.
5) I understand that we need a more central place which will facilitate more participation from all over Michigan. We are fine with it as long as we can get some volunteer from Farmington Hills, Dearborn, Southfield etc. who can book us a room/hall. Without a local participation it's hard to arrange a place for meeting. Till then we may have to make do with our current spot.
6) I am co-ordinating with CC to get the hall Officially booked so we don't face the elements next time. We are looking at the possibility of booking a room for free ( a facility available to non-profit groups such as us)
7) Me & CC had a meeting later where we compiled Minutes Of the Meeting (MOM) and other stuff too! Like a new Secure Yahoo or Google groups for secure dissemination of IV updates and chapter action plans. Teleconferencing options, Outreach, member drive etc. It will be communicated to Core as soon as I can type it into a document (along with the list of IV MI members as a trusted list)
8) Every participant volunteered to do his best to help IV and the State Chapter in our cause. It was also agreed that everyone will get more friends, neighbors, colleagues and acquaintances in the chapter, which is GREAT. We have had a really good start. Thanks to everyone who volunteered full support and will bring in more members.
9) Thanks to CC for the snacks and coffee. I will volunteer to get them next time.

I am planning on sending my spouse's application and my application on July 27th so that it reaches USCIS on July 30th. Anyone else planning to wait till the last minute to send the application even though they know that it will probably be rejected?

I've had some experience with Air France. BTW I have never flown with them. My father died on an Air France plane many years ago. His body was unloaded in Paris, and stayed there for 14 days while the French were celebrating Bastille day.
Maybe it was the association with this loss and Air France that made me never look at them. But also they are pretty expensive, no?

For folks around Philadelphia, if you are looking for a good part time programs, Wharton Business school is offering evening programs (Certificate) for Working Professionals. For me it was really a good experience doing the program.

Yes, I used to say like this five years back when I had time and age in my hand. I assume you are in early or mid 20's. I will put it differently for you.
Assume there is a big pond which starts from 1 feet and gradually increases up to 100 feet. People with one year work experience steps 0.5 feet. There are life jackets(GC) floating around the pool and whoever is lucky is picking it up. There are guys like me who are already in 5th-6th feet deep without finding the lifejacket, but we are sure if we go further, may be 3-4 feet more we WILL find it. There are guys who are lucky to find a life jacket at 1,2,3 feet also and happily float to the shore passing us. The fifth feet guy is practically seeing how the 6th and 7th feet guys are struggling. May be they are seeing some one in 8 feet to 10 feet. Now a big Tsunami (retrogression) comes and drags all the jackets 20 feet down further. These guys are dejected and some of these guys even pull their spouse/kids in one hand when they float/swim.
Dont forget, it takes one year to step 0.5 feet. Every year the pond management drops a fixed number of jackets. These guys keeps their hope alive based on the above fact. But these guys are seeing some kids passing in motorboat(LC Substitution) paying that guy 10K and getting a life jacket. Hmm pain, but even if I had a chance I would have also done it.
Now comes your saying. When the deepest s...t guys talks about their fate down the line and how to take their family safe ashore, a guy at 0.5/1 feet shouts saying "Dont give up, it is like deciding to take a sanyas because you are tired of dealing with social issues".
If you are in 5+ feet, I take your statment. Otherwise, you will not understand what I am trying to say until you reach 5+ feet without finding a life jacket and also pulling your family in one hand and seeing your seniors struggling more in 8+ feet. :)

I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)

Good you are in your late 20's. I am in my early 30's. Even 1-2 years makes huge difference for this GC. If I had the qualities of Gandhi, I would have not been here in this forum. Dont forget to call him as MAHATHMA Gandhi. I dont think there is even one MAHATHMA's here. All here are poor ATHMA's. Humans are great in adapting to any given situation. If a guy foresees that he cannot survive without knowing swimming, he will somehow learn that otherwise he is going to die. On other hand, the best swimmer in the world also cannot afford to swim for years just because he knows swimming. If you drop him in ocean with others, may be he will survive for longer time but he will seek for a life jacket or rescue sometime or later.
My whole point is everyone starts with optimistic approach when he starts. Show me one person who lands in US with pessimistic approach. You, me and all of our friends landed here with great vision for our life and career. The situation, surroundings, family issues, other personel issues drag him little by little to pessimistic way when he does not reach his set goals in time and instead stinks in the same spot having the required qualities to further his/her career and family.
A question for you: I know you will get married if you are not now and may have one kid at least at age 35. What will you be doing if you are here then without filing for 485. Will you have the same LEVEL of optimistic thinking? Answer honestly.

How can one know if ones employer has withdrawn/cancelled ones H1B visa? Apart from asking the employer, if one uses the EAC # ans checks the status on www.uscis.gov, will it be reflected over there?

As I promised earlier I would keep you guys updated on the process of this case.
On saturday I received the welcome as a permanent resident to USA letter. After trying to get a hold of my attorney I got in touch with him.
Heres the story. (this guy is a genius)
I asked him how it was possible when my PD wasn't current I got GC approval.
His answer was funny and pleasant. Magic :D
He said after the approval of my PERM during filing I-140 under EB2 he also filed a petition under "person with extraordinary ability interest to US" on my behalf. So in other words both the petitions were being processed together at USCIS. Me not aware of USCIS rules wasn't aware of all the lingo so didn't know.
Now the Extraordinary ability petition quota is always current. So when my extraordinary petition was approved the attorney informed the USCIS that to adjucate my adjustment based on this approval. Since the PD was current for this category. USCIS processed and approved the GC based on that. I love this guy I don't have to work for my current employer anymore hence he will get a big surprise when I turn in 2 day resignation. HA...

I wonder at what point of time this "three years of U.S. work experience" applies from. Is it that you should have 3 yrs exp when you applied for labor or is it when you apply for 485??
3 years experience period. It is an add on to the point system, if at all the amendment passes. At that point, there would not be any of the labor-140-485 process. You will be exempt from visa numbers, who knows what that system would be.

Just based on the definition given by DOL I decided Level III and Level IV to be EB2. Besides I am EB2 and my wage level is Level IV. I agree it is hard to conclude the cat based on wage level, I saw there were some Senior welders in Level III as well as Vice presidents of the companies. Quite a contradiction isn't it!!
I checked with the lawyer's office regarding levels I, II, II and IV on labor certification...The thing that determines EB2 and EB3 is what is written on the approved I-140.
For example, if it says 'Mem of Profession w/Adv Deg, or Exceptional ability Sec 203 (b) (2)' it is EB2. So it's what's checked in when u file your 140, and what it is approved for.
As far as levels I, II, III and IV are concerned, it does not matter regarding adjudication. The thing that only matters is either EB2 or EB3 (which is based on 140 approval as mentioned above) for Indians and Chinese in this case...

'Too many Cooks spoiled the broth'. If each person steering the boat paddles in a different direction, boat will go in circles.
True to certain extent but I don't know that there are too many cooks. We are all making suggestions but if there is any action based on that, we don't know. It's sorta brainstorming and some good ideas may come out of that.
If we stick to 'Don't ask what we can do for you, ask what you can do for us', we won't go far with it.
I have had other people express the same thing to me. It's about the collective group but if we cannot convince individual folks there isn't a way we can gather the group. We truly need to be proactive in recruiting people to the organization actively as opposed to being passive and saying it's fine - we will let whoever wants to join us join and whoever wants to contribute let them contribute.
I think as more number of people join this organization, the responsibility increases for the organization too. I also truly think the anonymity of the members is truly not helping and is in a way responsible for all the offensive posts in this forum. Once you attach a face and name and location to the IV handle, some of that should stop.

a) ban EB3-Eb2 porting
b) or EB1 abuse
c) or eliminate country quota
d) or recapture the visa
e) or don't count dependents in EB category.
f) or abuse by body shop consutling firms
g) or Automatic GC or citizen after x years........
h) ..... list goes on..
.. if all could be done @ same time - it would be perfect..
