The U.S. Department of Labor today announced that it has begun auditing all permanent labor certification applications filed by attorneys at Fragomen, Del Rey, Bernsen & Loewy LLP. The department has information indicating that in at least some cases the firm improperly instructed clients who filed permanent labor certification applications to contact their attorney before hiring apparently qualified U.S. workers. The audits will determine which, if any, applications should be denied or placed into department-supervised recruitment because of improper attorney involvement in the consideration of U.S. worker applicants.

even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
i would be very careful about making such an argument.
if this is true in IT then the opposite argument is perfectly valid (and that is the one USCIS/DOL will accept) - that the folks in EB2 are not doing a job that needs an advanced degree and they should be in EB3.
and if this is true:
"If the requirement is genuine then it is ok to give priority to EB2. But in reality(mainly consulting companies) the job requirement is decided mostly in Lawyers office or by candidate just because candidate has
master degree or 5 years experience."
then maybe applicants and their employers should start shouldering some of the blame for the current backlog instead of blaming everyone else.
i have no personal knowledge of this. in my field, there is no question that an advanced degree in needed. in fact, something well beyond it is the standard qualification.

How on earth doing AC-21 with H1 transfer be dangerous and using EAD be safe ???? And how is one abandoning his AOS by doing an H1 transfer ?? This post is totally misleading !
AC 21 means porting your EB sponsoring employer, whether you use H1 or EAD to work is your own decision. As someone mentioned in this thread, lots and lots of VOs might not be trained for AC-21 cases, which result in such erroneous denials ( which can be corrected by filing MTR) , let's not get confused by the errors made by USCIS. Errors are errors and it can happen for any case, to any body and off course this kind of errors can be corrected.

It looks like USCIS needs an "official bribe" to provide that information.No body really knows if all the applications filed are really there or they sold it to recycling companies.Send that to Senator and ask him how much would he take to get us that information.If Senator is cheaper than $5000, I would give it to Senator.

When I applied for EAD in NSC (paper file) it took 45 days to approve. Now I applied EAD for spouse on June 10th, no update so far.

I just called and spoke to a staff member at Lamar Smith's office. Apparently a lot of calls are being made :D. She knew why I was calling before I could tell her. I was told that the Rep. has not made a public stand on these bills yet. I told her that I would like the Representative to support these bills if and when they come to the floor.

he has said something similar before during the debates but there is no clear plan from any of the candidates. given the heat this issue is generating (and lack of publics understanding); i doubt any of the candidate will be vocal about it.

Hi,
Here is our situation. I am on H1 and have 485 pending for me and my wife. Both of us also have a valid EAD.
My wife was on H1 too, however since Oct'08 she relinquished her H1 status and took up another job using her EAD. Currently, we are planning to have her AP filed (her earlier AP expired in Dec'08).
Given all this, I have following questions.
a). Are there any risks associated with filing AP.
b). I presume her status has been valid so far... reason I ask is that we didn't do anything special in terms of communicating any official agency, when she jumped the boat from H1 to EAD. Were we supposed to?
c). Do you think I can get her on H4 while she continues to work using her EAD. I guess H4 option is more expensive? Any thoughts?
Appreciate any help/pointers on this.

I left it empty last time. It was approved. The only question I answered in Part 7 was "how many trips do you intend to use...".....I said multiple.

Nurses are already under shortage occupation list, even though some articles says otherwise! Their visas stopped from Ja. 2007. US hospitals will definitley feel the heat within months, since, much awaited their nurses are on hold at their parent country. US Hospitals have already invested funds for their CGFNS, RN. petitoning etc. Their emergency rooms will be overcrowded.. and wards will be shut down.. if visas not approved soon. .. Senators have always soft corner in health industry.. and they will not allow public to feel the heat..Blocking nurses visa will definitely put us in bad picture before the american public..

I thought A# is in I-140 approval notice.
It will still take many months for uscis to process our I-140 application.
I got the LIN number by calling USCIS...but have not got the receipt notice till now...
As there is an A# on I-140 form which needs to be written on all 485, 765 and 131 forms....i hope i get it in a day or two....
I-140 filed : July 12th
Reached NSC : July 16th
Receipt generated : July 16th
Still waiting for receipt Notice. :(

Not much unlike Health care companies that reward primary physicians that give minimal referrals to specialists. Such doctors are rewarded with free lavish vacation.

You can send 2 passport photos along with your other documents.. Since it is the first time, you wont have old AP and no need to send it also (;))

2. Reading this thread, I came out with a list of things that I need to send with my e-file application. Please correct me if I missed something or if I am sending too much.....
