I also missed out the stimulus payment due to my wife's ITIN. Bollocks to FAIR...
Hopefully we can make it backfire on them.

You do not need to have an SSN in 2008, since you can apply for the stithmulus payment in 2009 if you did not get it in 2008. This rule is posted on the IRS website.
The IRS webpage is saying something different. It makes it clear that you need the
SSN in 2008. (Second and last question on
http://www.irs.gov/newsroom/article/0,,id=181995,00.html)
Please do not refer to the stimulus payment as a rebate in any communications you have. It is not a rebate, which implies the return of money paid. Many people who earn no taxable income can apply for the stimulus payment. This makes it different from any tax scheme. The fact that the IRS administers the program does not prove that it is a tax program.
This is what I did. But the argument is not strong. The same applies to the
additional child tax credit. I got more money back then I paid, i.e., I had to
pay a negative amount of federal tax :-) (So this country is so mad that it
gives me an H1-visa for working and in addition pays me some money
for staying here.)
Anyhow, the IRS seems to offer a solution now:
Q. If I have a spouse with an ITIN and therefore choose "married filing separately"
status to qualify for the economic stimulus payment and later on amend my
original return to "married filing jointly" status, will I need to return the
stimulus payment?
A. No. [New 4/14/08]
Unfortunately, I filed already in January before there was a stimulus law.
Should I amend my 2007 return now, then file my 2008 return, and then amend
my 2007 return again??? As reason I give to circumvent a stupid law.

mind your language.....i just wanted to get an update...there was a big momentum built around passing the i-485 provision and now we are postponing it till CIR....We are also changing lobbying firm....These are two significant changes. First, the initial promise made to members is not being delivered upon and second, we are changing a firm that we have utilized for a year. Are there some problems going on? May be, the firm ditched us.....Look, all these are questions going thru my head....That's why I posted the question....I am bold enuff to ask the questions, rather than sit back and blindly believe whatever is fed to me.....I do not own IV and I don't want to either....
Just a legitimate question amidst all the changes.....
Cool down friend ... we all are in the same boat. I just want to make it clear that IV core team never promised anything about 485 provision or CIR. They said about some possibility ... the whole political scenario is very dynamic. Nobody (I believe not even the almighty God) can promise you anything and even if someone promises something, you should be mature enough to understand the feasibility of outcome.
Let's not fight amongst ourselves over these nonsense isuues again and again.

Guys,
Wanted to started this thread to get reviews on different law firms
I can understand the quality and committment of lawyers can make a huge difference especially in this unprecendented situation where all EB categories are made current now and now there is a rumour that it would be retrogressed back probably sometime next week with a new visa bulletin.
A lot of lawyers who are really committed and sincere to their client's clause: Getting them Green Card, are working overnight and over the weekend also so that their client can file I-485 ASAP and on the other hand few law firms are acting as slackers and not even responding to their client's emails.
Anyway, I am interested in knowing everyone's experience ( good or bad ) with law-firms and their recommendation.
My Own Case:-> I work for a multibillion dollar telecom company and joined this company almost 15 mos ago with a promise that they would start my GC immediately. Till Now, they have not yet file my labor. Their lawfirm is Larrabee http://www.larrabee.com/ in sanDiego. I don't have much experience with them as my application is still in my company's internal queue but based on the basis of my little experience, I would certainly not recommend them
Thanks
DD
I would seriously consider Rajiv Khanna - immigration.com. Very responsive, never delayed my case and answered all my questions thoroughly. Imagine this:
The best example is applying for 485 during the latest visa bulletin fiasco. Everybody in the community had a hint that USCIS may only accept a few applications for July. On the friday(June 29) before Jul 2 my missing document reached Mr. Khanna's office. Since they had too many applications to handle, the staff did all-nighters and sent my paperwork Saturday afternoon. It reached USCIS Monday July 2 at 9:00 am. Such commitment and hardwork is unparalleled in my opinion.

I have been thinking about whether to attend the rally or not from past few weeks. Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
Also, I live in DC area and can help if somebody needs to be picked from airport to the rally and drop them back if needed.
Hope to see thousands on 9/18th...
ALL THE BEST TO OUR CAUSE!
Regards.
Anucks, what great news!!! You are really committed and your sacrifice in working on Saturday will really pay off! Congratulaions on your decision, you will NOT regret it!!!!

I am in a silimar situation stuck at PBEC. I haven't posted anything because people are quick to come and bash (as you noted - even if we are just venting frustration - like the rest of everyone a few days back). Yeah, life is unfair but some things further add to it.
P.S. My husband attended the rally in SJ nevertheless (I was out of town.)
We are ready to help BEC guys in whatever way possible.Don't think you are left alone.

Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I dont know why all these mess in DOL, for taking the labor applications and sending ad instructions.

I think I-485 filing clause is needed. Please note that the USCIS is not staffed enough. So there is a high possibility that the priority date retrogression will continue even if all the current provisions included in the Frist bill is passed. They will retain the retrogression in order to control the number of applications. In such a scenario, it is important for us to try and introduce the I-485 clause, so that people could get their EAD while they wait for USCIS to clear the mess. My 2 cents.
I don't believe you are right. Cut-off dates are not established based on the USCIS workload and its staffing, but rather on the predicted balance between demand for and supply of GCs. Therefore if worst comes to worst we will see a backlog at the USCIS level again, ie their processing time will go way beyond today's 6 months. BUt if the DOS believes that they have enough GC available to meet the demand in each and every particular quarter they will adjust cut-off dates accordingly.

Yes, you can leave that blank as you are expecting the AP in mail and you would have specified that in Part3 question 5a.
hey eb3_nepa
One quick question....if the spouse is on H4, working on EAD and then travels outside and comes back in using her H4....can she then still use her EAD.....??

[QUOTE=jsb;617617]Fun apart, if you feel comfortable that you can find a job of your liking, and you believe your background will qualify you for a PR, consider Canada. It is a good place to live. You never miss home there. I am a Cdn citizen and have lived there for many years. Most likley I'll return back to Canada when I decide to retire. I know at least one person, who after living in the US for 11 yrs and unsuccessful in getting a GC, chose to make Canada his home, hoping to be there just for 3 yrs (needed to be a citizen), and then return to the US on TN permit. He has been in Canada for 8 yrs, and does not want to consider to move to the US any more.
Canada has a bit slower life, but is better socially and people are friendlier. It has less professional opportunities, lower pay and more tax. Yet, overall I think Canada is a better place to live. Why am I in the US? Purely for professional reasons. I visit Canada quite frequently, which I consider as my home.[/QUOTE
ya i think its a good option.....i dont mind the lower pay and more tax.......it will b much better than india........atleast i'll have peace of mind with PR as compared to uncertain wait in US

If you are talking about IT then to code in Java or VB you do not even need Engineering degree. Any guy with basic education can do the job with equal ease.
I think Eb3 people are still finding it hard to accept that it is only them resposible for being in EB3 blaming any body else will make no difference.
even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
I saw threads (this site or elsewhere) where EB2 ppl felt superior and blasted the threads where EB3-EB2 conversions were discussed.
IMHO, I would always say, if it is legal and possible and beneficial, ppl should think of conversion.
