H1b Transfer from IT to Marketing.

First THANKS to all for the fantastic information and help on this forum !
I have a H1 B based on IT ( Software Engineer).
I have already completed 6 years in the US, but I have three year extension till 2010 based on my labour pending for over 1 year.
I am not very keen about Green Card - But I wanted to change my job to Marketing for an insurance company (better pay and it is a role I like).
My questions are :
1) Can I transfer my H1 to do Markeing for the insurance company ( the job profiles are going to be different as my current job is in software) ?
2) Since I am on a three year extension based on my current Labor will it be an issue to transfer to the new company ? ( The new company is willing to transfer but is not willing to file a new H1).
Your advice is much appreciated.

India would be a good option for an Indian. For others I still think Canada and Australia are are the best options after US, in terms of standard of living, quality of life etc. It will take India decades more to achieve the same standards.

I think it is important to maintain diversity in the overall immigration. However the immigration law has never resulted in achieving diversity. In the period 1900-1910, immigrants came from Italy (22%), Austria (20%) and Russia (18%). In the 1950-1960 period Germany provided 20% of immigrants. In the 1991-2000 period Mexico provided almost 22% of immigrants. In the FY 2005, Mexico provided around 161,000 immigrants (around 17%) of immigrants. It is easy to fix a quota for those immigration categories where visa numbers are limited such as for employment. However spouses and minor children of naturalized citizens have no waiting period. So it will be very hard to control the immigration percentages based on country of origin unless there is a quota for US citizen spouses, and children of US citizens wantin to immigrate!
The problem here is that we don't have a country quota for foreign students and H1Bs. Thus when these people try to become permanent residents then the quota's are applied and that is the core problem. My take is that country quota should not be applied for employment based immigration. Employers should not be forced in to an affirmative action plan but rather hire the right person for the job.

“We have benefited greatly from the many foreign-born scientists, engineers, health care professionals, and teachers that help keep America moving forward,” said Shadegg, a member of the House Energy and Commerce Committee. “To our detriment, current policy mandates that we educate and train these brilliant individuals and then send them away to other countries to compete against us.”
H.R. 5744, The Securing Knowledge, Innovation, and Leadership (SKIL) Act, addresses this growing problem by increasing the allotment of H-1B visas, returning to the prior, higher level of 115,000, with potential for future increases. The bill would also allow foreign nationals who graduate from U.S. universities to stay in America and contribute to our economy by joining the American workforce.
“Unfortunately, we are not graduating the number of Americans with advanced degrees in math and sciences that our high tech and medical industries need to compete. Until we can fix the problem of not having enough highly skilled American graduates, we need to pass the SKIL Bill.”
Shadegg went on to say, “We stand to potentially lose the next technological giants like Yahoo! or Google if we do not keep America’s workforce competitive. We must maintain our edge by providing opportunities to highly educated and skilled individuals interested in staying here in the U.S.”

It�s good that at least some of us are getting VISAs, instead of VISAs being lost.
However if this continues we could see a big movement to switch over to EB2 with or without porting PDs. This may in turn help EB3 :)
We need to make this a sticky thread, so that we can brainstorm and put best ways to switch from EB3 to EB2 w/keeping older PDs.

This may be particularly appealing to those who had EB3 labor certifications filed on their behalf long ago and have had their cases pending while they have gained advanced degrees, acquired several more years of experience, and/or are offered jobs at higher levels. Keep in mind, though, that this involves filing a whole new LC under the PERM system for a new job opportunity and that the employer must actually require the additional degree and/or experience for all persons holding that job classification in order for the new case to be filed as EB2.

If you are so sure about this, why don't you consider spending your own money to get initial professional consultation. May be that will enlighten you. Many laws don't apply to Immigration Laws, so what you have written has no meaning.
Answer just this question - Can an H1-B worker claim that he/she should be sponsored for green card just because his/her coworker has been sponsored? Just think about the answer and may be you will see the reasoning.
People here are mixing different laws without knowing each law's applicability limitations.
