Even I was interested in similar scenario.
1. What happens when changing employers when I-140 and I-485 pending for less than 180 days?
2. From my understanding, the process needs to restart. However, do I have to do something to withdraw pending I-485.
3. Will it be termed as denied I-485 and create problems if I apply new I-485 with new employer?

I have a pending I-140 since July 2006. Today i lost my sponsor employer and don't know what to do. Can I switch my pending I-140 to another employer? What can i do NOT to lose status? I still have a valid H1B till Augist 2008 but I have travelled on my Advance Parole. Does that mean that my H1B is terminated? Please advise. Thank you.

Now a days any junior, if they ask me about GC process, I ask them what is the law firm of the company and find out how company handles GCs. Like, do they file at the last moment? do they get into a holding pattern and delay everything etc? One of the questions I directly ask people who seek my advice is , is the company's law firm fragomen? If they say yes, I ask them to talk to their manager and stay away from fragomen and change their jobs if its a slow process.

Because of unlimited H1b entire bill may be voted down if taken for consideration. It will be big surprise if any bill passes with unlimited H1b or GC in any category.
I don't understand the risk you are mentioning. How unlimited H1B is going to cause problem in eliminating retrogression in EB catagories?

I think I will try contacting a couple of offices. I know these folks are crazy busy but we could try leaving some printed letters in their offices for a week then go back and pick up? Any one had any luck here? Thanks!

That is the only option i had open to me...
I am a plumber, no degree, but equivalent qualifications.. dont qualify for H1B, and once you have shown perminat intent you carnt go back to a temp visa..so catch 22 for me.. i had to go out there get a job, and then start the process. And yes my future employer has been very understanding about it. they have been waiting for me for 2 years so far...so am anxious to say the least to get out there.
Strange thing is, in the midst of all this, i have had my fee bill, paid that, and now my attorny has received my DS230, and sent that back yesterday?? so god knows what is happening. even though the dates arnt current.???
i give up trying to figure out what is going on over there. im hoping they will just finish up with it and send it to the embassy in london, so at least it will all be here even if it just sitting here waiting for a number to become available.
My be the november bulitin will show some kind of movment?

Your application will be processed until the stage where a visa number is needed to adjudicate your case. Since EB3 (am assuming here) ROW is not current. Your app will wait until visa numbers for your category becomes current. In other words, your last sentence may be true. But not if you become vocal about your plight and fight for it through activism (i.e by supporting Immigration Voice).
Exactly correct - if your pd is no longer current, your application will still progress. If all goes well, it will then fall into the "approved pending visa availabilty" - ie when your pd becomes current again, it will quickly be granted. This phenomenon is how uscis managed to approved so many applications from may onwards this year, there was a queue within a queue, so to speak :)
Back to the numbers game - what I was trying to say is, regardless of what the total numbers of pending applications are (because no one really knows - we can have best guesses), and not taking into count the country caps, the main issue is effciency of processing. The country quotas could disappear, and the overal limit couyld be increased, but without reforming the actual processing side the speed of approval will not change.

..from any single state, afaik (perhaps with the exception of NJ, don't have the exact numbers - but in stark contrast to many other states... ).
Also note, the attendance at short notice for the SJ rally was phenomenal.
Let's just say Californians are more motivated and active then many from the DC area, and you can expect an even larger crowd the next time around, with better planning and more time imo.

One reason for the poor performance from DC area folks is that a GC does not open many avenues for folks in DC area. You could change from a 70K job to 90K job, may be. In Silicon Valley there are many more opportunities. You are talking about a change from 80K to may be starting a million $$ company.

I agree that porting to EB2 is the best route. But my company was very reluctant to file another labor to port my case to EB2. They thought thur PERM, they may have to hire some applicant if they meet the requirements. The lawyer thinks PERM is risky. I know they are trying to avoid EB2 labor at any cost, though I also know a few friends who had the PERM labor application recently rejected.
Anyway, bottom line for me and others in the same situation is that we are stuck with EB3. And maybe stuck in the rut for a long long time unless something magical happens....

In real life, when resources become less and scarce - even blood relatives fight and kill each other. We here don't even know each other.

Do you guys think its worthwhile to go back instead of trying waiting for the retrogression to end. From the looks of it, i doubt there is any chance of an immigration bill before the elections. if there is no bill then we will end up waiting for 8-10 years for the dates to be current.
if they remove the US masters from the quota, imagine the rush it will cause in the universities, effectively it will imply that you will get a green card after you study for 2 years in US. take a 20-40k loan and get a GC. There is no country quota for F1. i had friends who were rejected for F1 because they were 'potential immigrants' wonder how this theme will play out in future.
from this shore returning back seems to be an alternative worth considering...or maybe its just todays depression talking.
Another perspective is that if people with Masters or higher degree are exempted from the EB quota, it will in fact help in moving the priority dates current, since there are lot of people in wait who already have advanced degree from US universities and won't be using up the visa from the EB quota.
