I am very sorry to hear about your case. As others are pointing out - it is not all over yet. Make sure you get in touch with a good lawyer and take a good route to fight USCIS.
Also, could you please let us know of your PD? Doesn't look like you are current right?
As of September VISA bulletin my PD is current, its July 2006 under EB-2

Total immigration numbers, not employment. The direct references in the report are:
Figure 3 Page CRS 9.
For the 2005 numbers, I approximated, using Appendix A on page CRS-22, which covered the top 50 countries sending immigrants and that was around 87% of the total.
Sorry - I can't currently access the report you quote your oringinal figures from at the beginning of your quote. Are these numbers of total immigration, or immigration in the highly skilled category?

Some of the core members are also stuck in BEC. But they still worked selfleshly. And don't preach injustice to me, I came here to study in 1999, got one labor (PD 2002) rejected on technical grounds, went in for other labor PD 2005, so my situation is probably worse than you.

Guys,
Firstly thanks for the great show at DC, we are really beginning to bring this issue to the fore front. I could not attend myself but I did make a small contribution as a token of my support. However we should capitalize on the momentum and follow this up with some thing more substantial so that every one knows that this was not a one off spark but is a clear growing fire.
I guess (just by reading posts on IV) one point which came out pretty clearly was that IV has good support in some regions and really very little support in some others (support as in visible support, where people are willing to show up for rallies, contribute to IV�s efforts etc), I guess this pretty much means that we need to focus on building the regional chapters of IV, like have strong/formal leadership and goals of each of the chapters.
I was also thinking that we can possibly learn a lot from the protests by undocumented immigrants. They had record turnouts in their rallies and most of their people stayed away from work to take part in the efforts when ever there was a call for the same.
I thought which keeps hitting me is about a simultaneous rally in all major US cities? I know that undocumented immigrants did this and that really worked for them and once again this will build our regional chapters coz the onus will clearly be on each of the regional chapters to achieve targets (target in terms of membership, turnout in rallies, fund raisings etc ) set by IV
Some of the advantages of having simultaneous local rallies is that
1) No travel expenses � (So that we can spend more money on media and lobbying than travel expenses)
2) No need to time spent on travel � ( Better turnouts)
3) Comfort � every one can just go to a local rally point (Better turnouts)
4) Stronger regional chapters � (work at grass root levels)
Also if this can be done on a Saturday then I am sure the turn out will be much better.
What do you think?

Nope. Need 60 votes to do anything in Senate and that is why even though the Dems have a so called majority then cant get anything done.
However, you need 60 votes to end a fillibuster. A fillibuster is the method used by senators to stall a bill. They will force debate to continue indefinitely. To overcome the forced debate, you need 60 votes (which is what the cloture motion is).
To pass the bill, only 51 votes are needed. If there is a tie (50-50 or 49-49 or any valid combination), the the Vice President casts his vote to break the tie (and we all know on which side the VP is on)

You should make an appointment with info pass and carry all needed documents with you. They should be able to help. It is not perfect solution but it works. My wife had applied her AP which did not show up even after three months, in mean time we have had an emergency. I made an appointment with info pass, it was approved within a day. It is worth a try.

IV is asking people to participate in calling senetors to support Lofgren bills. Its asking for visa recapture? How does this translate in saying nothing is being done? Let me ask you politely in which campaign's have you participated
IV is basically saying EB3 folks stop all initiatives. Rather convert to EB2. It's comfortable to say IV core and decisionmakers are composed of EB2 folks.

I heard Nancy say she would get started with some legislation that both parties and president agrees and she mentioned CIR. I think, if the republicans are smart they will quickly pass a version of it that they still can control - during the lame duck session when the old house returns for a few days.
But the biggest new problem will be suedo retrogression due to bottlenecks at Service centers! so near yet so far!

thanks for the clarification. I have a BE and an MBA form India with over 6 yrs experience in the USA and elsewhere. Not sure if i qualify as advanced degree.
So peopel with advanced degree can move out of EB3 or any EB quota is it ? Their PD will be current ?
Not necessarily getGC. I am EB3 but i am a Masters from the US. Sometimes for fresh hires lawyers play it safe by applying in EB3. I had emailed someone at competeamerica.com and they had mentioned that an "advanced degree" is either a masters or a PhD. You mentioned that you had an engineering degree from India. Is that a B.E. or an M.Tech/M.E.? If you have a master's degree from India, you need to ask ur lawyer if that qualifies as an advanced degree.
But even otherwise, it still benefits you, coz say even 20-25% of Current EB3 have master's degrees, they will be out of the queue and you will be benefitted. I know it doesnt sound like a benefit, coz it is not a direct one, but if you look at it from a different angle, you will see it.

It's slow poison.. Great deception. You can't get it and You can't let it go. After waiting so long (7+ years in GC road) I got nirvana. One early morning I think over back and relies what the hell I did with my life and career for this stupid card. So I put my energy in study. Hoping to complete MBA by summer and move forward. Waited so long so i don't have any more patience or emotion left. I have to move on with life.. :p
Have a cup of coffe, it is sprint break time, I am taking my daughter out....also I am going to meet some friends over this weekend.
This EB-2, EB-3, ROW, India, China..... only hurts me when I think about it! As long as I am busy with my day to day life.....life is beautiful.

This, of course, is in addition to the recurring contributions that I already make.
Everyone, please take initiative in this effort.
We spend thousands of dollars and years waiting for our green cards, why is it so hard to realize that this is only to help ourselves?.
These contributions are more or at least as important as our car payments, mortgage, or educational loans. This effort will only ensure (by giving us our well deserved GCs) that we can stay here on a permanent basis and not have to be sent back home (or is it really home?, for so many of us who have spent close to a decade or longer, here) at the slightest disturbance in the economy.
I hope you will make the right decision.

that's ok, you are eb2. so no worries, totally understand. no one is asking you to donate, did u get a personal email or phone call from me asking you to donate? You came to this thread, read my post, felt guilty conscious, and thought someone is asking you to donate, and came up with an absurd reason not to contribute. who asked you to contribute in the first place?

I had applied for I-140 in march 2007 in regular processing (not premium). its in nebraska center which i think is taking quite a long time. should i hurry this up by upgrading to premium and then apply for 485?? i dont want to wait cuz who knows those 485 dates might retrogress in a couple of months.
i wud highly appreciate any recommendations/suggestions.
