If New H1B and Transferred H1B are same....then problem is solved.

You are right. .. New H1B and Transferred H1B are same
I also mentioned this in a past post of this thread (Page 5) as well
Typically, H-1B transfer means new H-1B petition for the beneficiary who is/was in H-1B status and is not subject to H-1 cap.

I think that going back to your home country ONLY because you feel overwhelmed by the delays in GC processing/retrogerssion (assuming you are quite content in your job and standard of living) is not a good idea. Especially true in the event that you and your family experience difficulties in adjusting professionally and socially after returning back. Chances are you might soon get a feeling of having taken a wrong decision in the heat of the moment, especially if the guys who stay back and ride this retrogression storm see some relief while you are still trying to adjust to the changed environment of your home country. You may even get tempted to come back and give the GC thing another shot but then you have to start at square one again.
Going back to home country only because of the shortcomings of GC process is like deciding to take a sanyas because you are tired of dealing with social issues. I belive a decision to renounce something should only come from a position of strength. A true jogi is one who understands the triviality of society and decides to rise above it...not the one who denouces it because he can't deal with it.
As the saying goes..its darkest before the dawn...I truely hope this is the case for all of us here...
We all know its not an easy 1-2-3 to happen in a jiffy for something to be debated in the Capitol hill...signed by the President..and becoming a law, against all odds of gas hikes, natural disasters, anti immigration...Immigration stands on a scale of 1 to 10,maybe number 9 or 10.

The most important part of rally is the lawmaker meeting because they decide to bring up the bills and then vote on them.
There are 635 lawmakers: 100 senators + 535 house members. It would be great if we could set up at least 1 meeting with every lawmaker and more meetings with immigration sub committee members.

If you seek "hidden" messages, you'll find them everywhere, including Leonardo DaVincis MonaLisa ( like in 'Da Vinci Code'). Are you a mind reader? How can you tell what's in my mind? You barely know me! So please don't jump to conclusions.
Make no mistakes, I would like to change the course of events. Otherwise I wouldn't be here, and I wouldn't have walked those two miles in DC with the rest of my brethren! I just don't know how as I am new to this game - building an organization from the ground up, motivating people [ without losing my temper over shameless taunts and lame excuses ], inspiring people to raise their voices against injustice etc. I'm not exactly a leader material like Aman Kapoor.
If it gives you any satisfaction - yes, I do blame myself as much as I blame others for the sorry state of my state chapter. If you read my previous post you'll see that I've used "we" (i.e. includes me) and not "you" or "them". Hope this makes things clearer to you.
I read and understood the whole paragraph with both "published" and "Hidden" messages what you wanted to convey. If you do not see much activity on your state forums, why do not you take the lead to reverse the course? That would be the right direction rather than suggesting to change the skeleton. Do you blame yourself (Since you are claiming yourself a member)for not having much activity in your state level? If not then problem lies there and that is my hint to you.

I still don't understand what you are saying.
Now, the bad part ... the achilles heel of every high-skills amendment is the tethered H1B quota tricks. They are exempting everyone who has US masters or a non-US master in STEM from H1 quota, effectively making H1 quota = A LOT MORE.
Are you saying the future greencard applicants will have to compete with lot more new H1b s?? Wouldn't this bill help alleviate the retrogression problem and those with approved LC, I-140 etc??

Hi guys,
This is what my lawyer said.
If you/spouse have used your EAD or are using your EAD then your "Current Immigration Status" is "Adjustment of Status Pending/Parolee". If not then it is either H1B or H4.
If you/spouse have actually travlled outside the US and re-entered using the Advanced parole, then your "Manner of Last Entry" is "Parolee". If not then it is what it says on your I-94 (H1B or H4).
You do **NOT** need the $80 Biometric fee for the Advanced Parole.
Guys,
do any body know what documents a minor need for reentry using AP?
Do they need EAD or just I-485 receipt is enough. please reply ASAP.
thanks

I agree with Bharat Premi...
Even according to my lawyer there are not much cases in 2004 /2005 EB3 I...
Guess many have chosen EB2 as they were eligible by that time .I dont understand why EB3 I is being projected so negatively.
Many have already transferred EB3 to EB2.
2001/2002 may be there are still duplicate open applications which USCIS have to sort out .
Lets hope for the best...But seeing Bharat Premi responses...builds hope.
Thanks

I did not want to initiate that discussion because it may be a long one, but let me share my experience:
My recommendation is that folks take an MBA only if you already have a firm position in mind that you want to go for an executive or upper management position in the future. That line of thought is specially applicable when you are paying the whole thing from your own pocket !!! Before working in a management position or taking the MBA, I did not know how much I liked the idea of becoming a CIO or CEO. I tought I knew it, but until you actually experiment it, as many things in life you don't know for sure. Well, after completing 50% of the program I realized that was not my short or mid-term goal to work as an executive reading accounting net income balance sheets or maketing professional, even if I had the GC handy.
In my personal opinion, taking an MBA merely to enhance your project management when you are PAYING FROM YOUR OWN POCKET it may be a very bad strategy. If others are paying for you, of course that is fine, but it is not the case for many of us. I had only one or two courses related to project management anyway.
If you just want to enhance your project management skills, you might want to invest in way more direct courses such as PMP, ITIL, Microsoft Operations Framework. You should be able to complete those with a fraction of the cost and time of an MBA and probably achieve more return and knowledge than what the MBA can offer you when it comes to project management.
For those who are sure you want to read balance sheets, work with marketing analysis and go away from the hands-on experience, then MBA may be right for you.
I don't want to discourage you, but there are documents out there showing that MBA's are overrated and the importance of it is under scrutiny. Since I already found offers from multiple employers who were willing to pay 100% (if you are a qualified professional like us, it is not difficult to find employers willing to pay for it once you can change jobs) personally I thought I could wait a little longer to get the MBA and invest in IT certifications now paying from my own pocket.
Just my humble opinion.
Agree with you, it is always about knowledge, information, contacts, and ability to adapt rather than investing on high cost education unless you have someone else paying or u r stinking rich or u get a scholarship.

Yes that is true. They are lobbying strongly for H1b though they are supporting GC increases. Actually with H1b you can stay unlimited years if you apply gc. So there is no urgency for corporations to resolve the issue. They do not have fear of losing you as you are going to stay in USA until you get green card
You are right, but they do have some or may be a little more interest in the GC process too.
1) Because they are paying a lot of money to these consultant companies which they want to reduce.
2)Come to wall street, you will see so many consultants that are needed here to keep this economy running. A high number of H1-B will definitly reduce the price but still they will not get what they want meaning a permanent employee on a lesser pay. Tech companies cannot hire a person permanently because he is stuck with his employer who has filed his GC.
The companies cant continue to pay a lot to these consultanting companies.
Secondly this country should attract good brains, who might not want to come here. Believe me my friends in india are happy there and do not want to come here. They are living in there own homes with families, enjoying every part of our indian culture and are happy.
If nothing really works out here I will be looking out for an oppurtunity back home.

Thank you for your honest opinion.
1) totally understandable

It takes different things to motivate different people, which is why I am looking for real feedback to improve moving forward. I hope they have some kind of link with DOL. Because my approved labor case status changed from Certified to Data Review and back to Certified.
Where did you see the change in case status? Do you have access to the PERM system? Are you the employer/representative of the firm responsible for PERM??
thanks
